This End-User Licence Agreement (“EULA”) is a legal agreement between you and Maneki Neko Productions Inc., a company registered in Panama (“we”, “us”, “our”), for the use of the game “HitStop” — including the mobile application, the web-based demo version, and any related software, updates, and documentation we provide (together, the “App”).
By downloading, installing, accessing, or playing the App, you agree to this EULA. If you don’t agree, don’t install, access, or use the App.
This EULA applies alongside our Terms of Service and Privacy Policy. If there’s a conflict between this EULA and the Terms of Service on matters specific to the App software itself, this EULA controls.
1. Licence
We grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use the App on devices you own or control, or to access the web demo version through a supported browser, for your personal, non-commercial use, in accordance with the usage rules of the app store you downloaded it from (where applicable).
This is a licence, not a sale. We retain all rights, title, and interest in the App.
2. What you may not do
You may not:
- Copy, modify, or create derivative works of the App (except as allowed by applicable law)
- Reverse engineer, decompile, or disassemble the App, except to the extent this restriction is prohibited by applicable law
- Rent, lease, lend, sell, sublicense, or otherwise transfer the App to anyone else
- Remove or alter any copyright, trademark, or other proprietary notices
- Use the App to build a competing product or to train machine learning models
- Scrape, extract, or republish the game’s mechanics, timing data, scoring logic, or other content delivered through the App
- Use automated systems (bots, scripts, macros, input automation, or timing tools) to interact with the App or to manipulate scores, streaks, leaderboards, or accuracy ratings
- Exploit bugs, glitches, or unintended behaviour to gain an unfair advantage in scoring or leaderboards
- Use the App in any way that breaks applicable law or the usage rules of the app store
3. Content and intellectual property
The App and all content delivered through it — including game mechanics, visual design, audio, text, graphics, logos, the underlying software, and the “HitStop” name and brand — are owned by Maneki Neko Productions Inc. or licensed to us, and are protected by copyright, trademark, and other intellectual property laws.
Nothing in this EULA transfers any intellectual property rights to you.
4. User content
If the App lets you submit content (for example, a username, a profile photo, or feedback), you keep ownership of what you submit, but you grant us a worldwide, royalty-free, non-exclusive licence to use, store, reproduce, and display that content as needed to operate and improve the App. You confirm you have the right to grant this licence and that your content doesn’t infringe anyone else’s rights or break the law.
5. Updates
We may release updates, patches, and new versions of the App from time to time. Some updates may be required to keep the App working. Your app store may install updates automatically depending on your settings. This EULA applies to all updates unless a separate agreement accompanies them.
6. In-app purchases and subscriptions
The App offers in-app purchases and subscriptions, including:
- Coin packs — one-time purchases of virtual coins used to play additional rounds within the App
- HitStop Pro — a subscription that removes ads and may include other benefits described in the App at the time of purchase
These purchases are sold and processed by Apple or Google under their own terms, and your payment relationship is with them. Cancellations, refunds, and billing issues are handled through the relevant app store.
Coins and other virtual items have no monetary value, cannot be redeemed for cash, and are non-transferable. We may adjust the price, availability, or function of coins, coin packs, and other virtual items at any time. Unused coins may be forfeited if your profile is removed or your access to the App is terminated for breach of this EULA.
HitStop Pro subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period, in accordance with app store rules.
The web demo version is provided free of charge and is limited to 5 turns per session. It does not include in-app purchases.
7. Third-party services
The App may rely on third-party services (for example, for crash reporting, analytics, advertising, authentication, or payment). Those services have their own terms and privacy policies. We’re not responsible for the content or practices of third-party services.
8. No warranty
The App is provided “as is” and “as available”, without warranty of any kind. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and that the App will be uninterrupted, error-free, or free of harmful components.
We work hard to make the game’s timing and scoring accurate and fair, but we don’t guarantee that every measurement, score, or leaderboard entry is free of error. If you spot a problem, tell us at contact@hitstop.app.
9. Limitation of liability
To the fullest extent permitted by law, Maneki Neko Productions Inc. and its directors, employees, contractors, and licensors won’t be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the App.
Our total aggregate liability for any claim arising out of or relating to the App is limited to the greater of (a) the amount you paid us for the App in the twelve months before the claim, or (b) USD 50.
Nothing in this EULA limits liability that can’t be limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.
10. Termination
This EULA takes effect when you install the App or first access the web demo, and continues until terminated.
You can terminate it at any time by uninstalling the App, deleting any copies you have, and ceasing use of the web demo.
We can terminate it immediately if you breach any of its terms. On termination, the licence granted to you ends and you must stop using and delete the App. Sections that by their nature should survive termination (ownership, disclaimers, liability, governing law) will do so.
11. App store terms
Apple App Store users
You acknowledge that this EULA is between you and Maneki Neko Productions Inc. only, not with Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Any claims relating to the App (including product liability, failure to conform to legal requirements, or consumer protection claims) are our responsibility, not Apple’s. Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you.
Google Play users
You acknowledge that this EULA is between you and Maneki Neko Productions Inc. only, not with Google. Google is not responsible for the App or its content and has no obligation to provide support or maintenance.
You also agree to comply with the usage rules of the relevant app store.
12. Governing law
This EULA is governed by the laws of the Republic of Panama. Any dispute arising out of or relating to this EULA will be resolved in the courts of Panama, unless mandatory consumer protection laws in your country of residence give you the right to bring a claim locally.
13. Changes
We may update this EULA from time to time. If the changes are material, we’ll notify you through the App or website before they take effect. Continuing to use the App after changes means you accept the updated EULA.
